- PURCHASE & PAYMENT
5.1 Price and Payment
All prices are inclusive of VAT at the rate appropriate to the Kingdom of Saudi Arabia. If for some reason we are unable to ship or deliver your goods, the value of the items that are not shipped will be refunded to your wallet in your AlhassanBrand Account or to the original method of payment.
All prices are exclusive of delivery charges. The total cost of the order is the price of the products ordered plus the delivery charge.
Once you have selected all items which that you wish to buy, they will be added to your cart. The next step will be to process the order and make the payment. To that end, you must follow the steps of the purchase process, indicating or verifying the information requested in each step. Furthermore, throughout the purchase process, before payment, you can modify the details of your order. You may use, as payment method, the following cards: Visa, Mastercard, American Express, Paypal and online banking accounts.
To minimize the risk of non-authorized access, your credit card details will be encrypted. Once we receive your order, we request a pre-authorization on your card to ensure that there are sufficient funds to complete the transaction.
When you click "Authorize Payment", you are confirming that the credit card is yours. Credit cards are subject to verification and authorization by the card issuing entity. If the entity does not authorize the payment, we shall not be liable for any delay or failure to deliver and we will be unable to conclude any contract with you.
5.2 Colors
We have made every effort to display, as accurately as possible, the colors of our products that appear at the Website. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.
5.3 Packing
Unless otherwise provided, we will comply only with its minimum packing standards for the method of transportation selected. The cost of all special packing, loading or bracing requested by you will be paid for by you.
5.4 Shipping & Delivery
AlhassanBrand.com delivers from different warehouses in different cities throughout the Kingdom of Saudi Arabia. We generally aim to deliver orders within seven working days of orders being placed. However, sometimes during busy sale periods, deliveries may take longer. Please note that Friday and Saturday are not classed as working days. If you have not received your delivery in ten working days please contact our Customer Services through info@alhassanbrand.com .
5.5 Title and risk of loss
Delivery to carrier shall constitute delivery to Buyer, and thereafter risk of loss or damage shall pass to Buyer. Any claim of Buyer relative to damage during shipping or delivery should be made directly to the carrier. Any claims by Buyer against Our Company for shortage or damage occurring prior to such delivery to carrier must be made within five (5) days after receipt of the goods and accompanied by original transportation bill signed by carrier noting that carrier received the goods from Our Company in the condition claimed. Notwithstanding passage of the risk of loss to Buyer, title and right of possession to the goods sold hereunder shall remain with Our Company until all payments hereunder, including deterred payments evidenced by notes or otherwise, carrying charges, shall have been made in cash, and Buyer agrees to do all acts necessary to perfect and maintain such right and title in Our Company.
5.6 Return of Products
Goods can be returned within (7) days from date of delivery.
Wrong Size items and quality problem items can be exchanged. For defective products, if a defect or damage is confirmed on the returned products, the products will be wither exchanged or returned based on the user’s preference within ( ) days from receipt.
The following items cannot be returned or exchanged: bodysuits, sleepwear, swimwear, perfumes, jewelry, and accessories.
- INTELLECTUAL PROPERTY AND OWNERSHIP
You recognize and agree that all copyright, registered trademarks and other intellectual property rights on all materials or contents provided as part of the Website belong to us at all times or to those who grant us the license for their use. You may use said material only to the extent that we or the usage licensers authorize expressly. - EVENTS BEYOND OUR CONTROL
We will not be liable for any non-compliance or delay in compliance with any of the obligations we assume under a contract when caused by events that are beyond our reasonable control ("Force Majeure"). Force Majeure shall include any act, event, failure to exercise, omission or accident that is beyond our reasonable control, including, but NOT limited to, the following:
- Strike, lockout or other forms of protest.
- Civil unrest, revolt, invasion, terrorist attack or terrorist threat, war (declared or not) or threat or preparation for war.
- Fire, explosion, storm, flood, earthquake, collapse, epidemic or any other natural disaster.
- Inability to use trains, ships, aircraft, motorized transport or other means of transport, public or private.
- Inability to use public or private telecommunication systems.
- Acts, decrees, legislation, regulations or restrictions of any government or public authority.
- Strike, failure or accident in maritime or river transport, postal transport or any other type of transport.
- Government restrictions
It shall be understood that our obligations deriving from contracts are suspended during the period in which Force Majeure remains in effect, and we will be given an extension of the period in which to meet these obligations by an amount of time equal to the time that the situation of Force Majeure lasted. We will provide all reasonable resources to end the situation of Force Majeure or to find a solution that enables us to fulfil our obligations by virtue of the contract despite the situation of Force Majeure.
- LIMITATION OF LIABILITY
Unless otherwise indicated expressly in these Conditions, our liability regarding any product acquired on our Website shall be limited strictly to the price of purchase of said product and shall not exceed the said price.
Due to the possibility of errors in storage and transmission of digital information, we do not warrant the accuracy and security of the information transmitted or obtained by means of this Website, unless otherwise indicated expressly on this Website. All product descriptions, information and materials shown on this Website are provided "as is", with no express or implied warranties or conditions of the same, except those legally established. - الشراء و الدفع
5.1 السعر و الدفع
جميع الأسعار شاملة ضريبة القيمة المضافة بالنسبة النظامية المعمول بها في المملكة العربية السعودية. إذا لم نتمكن من شحن البضائع الخاصة بك أو أو توصيلها أو تسليمها لسبب ما ، فسيتم رد قيمة المنتجات التي لم يتم شحنها إلى محفظتك في حساب AlhasanBrand الخاص بك أو إلى حسابك البنكي المسجل لدينا.

5.2 الألوان
نبذل أقصى ما بوسعنا لعرض ألوان منتجاتنا التي تظهر على الموقع الإلكتروني بدقة أكبر. و لكن مع ذلك ، لا يمكننا ضمان دقة الألوان بجهاز العرض الخاص بك.
5.3 التغليف

5.4 الشحن والتسليم

5.5 انتقال مسؤولية سلامة المنتجات
يعتبر التسليم للناقل تسليمًا إلى المشتري ، وبعد ذلك تنتقل مسؤولية المنتج إلى المشتري. يجب تقديم أي مطالبة من المشتري تتعلق بالضرر أثناء الشحن أو التسليم مباشرة إلى شركة النقل. و في حال أي مطالبات من قبل المشتري عن نقص أو تلف يحدث قبل هذا التسليم للناقل يجب أن تقدم لنا خلال خمسة (5) أيام من استلام البضاعة ومرفق بها فاتورة الاستلام. و مع ذلك يظل حق الملكية والحيازة للبضاعة المباعة أدناه بحوزتنا إلى أن يتم سداد كافة الدفعات المستحقة.
5.6 استرداد أو استبدال المنتجات
يمكن استرداد المنتجات خلال (7) أيام من تاريخ التسليم.
و يمكن تبديل المنتجات في حال كانت لا تتطابق مع مواصفات الطلب من حيث الحجم أو اللون خلال (س) يوم من استلامها. أما إذا كانت المنتجات معيبة أو وجد بها خلل أو تلف جوهري لا يعود لإهمال المشتري، فيمكن استرجاعها أو تبديلها بحسب ما يتوافق مع رغبة المشتري.
و لا يمكن استرجاع أو تبديل الفئات التالية من المنتجات: ملابس داخلية وملابس نوم وملابس سباحة وعطور ومجوهرات وإكسسوارات.
- حقوق الملكية الفكرية
يقر المستخدم و يوافق على أن جميع حقوق الطبع والنشر والعلامات التجارية المسجلة وحقوق الملكية الفكرية الأخرى على جميع المواد أو المحتويات المقدمة كجزء من الموقع الإلكتروني مملوكة لنا في جميع الأوقات أو لأولئك الذين منحوننا ترخيصًا لاستخدامها. و بناء عليه لا يجوز للمستخدم استخدام المواد المذكورة إلا بعد إذن كتابي منا بذلك. ولا يجوز استخدام علاماتنا المسجلة دون الحصول على إذن خطي مسبق منا.

قد يعثر المستخدمين على روابط لمواقع أطراف ثالثة على الموقع الإلكتروني. قد تشمل هذه الأطراف الثالثة الشركاء والجهات الراعية والمرخصين والموردين و لا نتحكم في أي محتوى لطرف ثالث. و من خلال النقر على روابط الأطراف الثالثة، يصبح المستخدمون خاضعين للشروط والأحكام وسياسات الخصوصية لتلك الأطراف الثالثة. قد يتغير محتوى وسياسات الأطراف الثالثة وفقًا لتقدير مالكيها.
- القوة القهرية
لن نكون مسؤولين عن عدم تنفيذ أو تأخير لأي من الالتزامات التي تكون على عاتقنا بموجب هذه الاتفاقية في حال نتج ذلك عن أحداث خارجة عن سيطرتنا المعقولة ("القوة القاهرة"). يجب أن تتضمن القوة القاهرة أي فعل أو حدث أو حادث خارج عن إرادتنا المعقولة ، بما في ذلك ، على سبيل المثال لا الحصر ، ما يلي:
- الإضراب أو الإغلاق
- الاضطرابات أو الغزو أو الهجوم الإرهابي أو التهديد الإرهابي أو الحرب (المعلنة أو غيرها) أو التهديد أو الإعداد للحرب.
- حريق أو انفجار أو عاصفة أو فيضان أو زلزال أو انهيار أو وباء أو أي كارثة طبيعية أخرى.
- عدم القدرة على استخدام القطارات أو السفن أو الطائرات أو وسائل النقل الآلية أو وسائل النقل العامة أو الخاصة.
- عدم القدرة على استخدام أنظمة الاتصالات العامة أو الخاصة.
- الأفعال أو المراسيم أو التشريعات أو اللوائح أو القيود الحكومية.
- الإضراب أو الفشل أو الحوادث في النقل البحري أو البري أو النقل البريدي أو أي نوع آخر من أنواع النقل.
- القيود الحكومية.
و بناء عليه، يتم تلقائياً تعليق الالتزامات خلال الفترة التي تظل فيها القوة القاهرة سارية، و يمنح تمديداً بهذه الالتزامات لفترة زمنية مساوية لوقت استمرار حالة القوة القاهرة.
- تحديد المسؤولية
ما لم يُنص على خلاف ذلك صراحةً في هذه الأحكام و الشروط ، إن مسؤوليتنا تجاه أي منتج تم الحصول عليه عن طريق موقعنا الإلكتروني تقتصر فقط على سعر شراء المنتج المذكور ويجب ألا تتجاوز ذلك السعر.
و نظرًا لاحتمال حدوث أخطاء في تخزين ونقل المعلومات الرقمية ، فإننا لا نضمن دقة وأمن المعلومات المرسلة أو التي يتم الحصول عليها عن طريق هذا الموقع ، ما لم يرد خلاف ذلك صراحة على هذا الموقع. يتم توفير جميع أوصاف المنتج والمعلومات والمواد الموضحة على هذا الموقع "كما هي" ، دون أي ضمانات أو شروط صريحة أو ضمنية ، باستثناء تلك المنصوص عليها نظاماً. من المفهوم أن المنتجات تكون مطابقة للاتفاق إذا كانت: (1) تنطبق مع الوصف الذي قدمناه وتمتلك الصفات التي قدمناها في هذا الموقع ؛ (2) صالحة للأغراض التي تستخدم عادة بحسب نوعها.
- النظام الحاكم و حل النزاعات
يخضع استخدام موقعنا الإلكتروني وعقود شراء المنتج من خلال الموقع المذكور للأنظمة و اللوائح السارية في المملكة العربية السعودية. و في حال نشوء أي خلاف بين الطرفين (لاسمح الله)، يتم حله ودياً، و إن تعذر ذلك، يكون الحل من خلال اللجوء إلى الجهات القضائية المختصة بالمملكة العربية السعودية.
